Welcome to VibeVite. VibeVite is a product of Boomatics Software LLC, a company incorporated in the United States of America ("Boomatics," "we," "our," or "us").
These Terms and Conditions ("Terms") govern your access to and use of vibevite.com, our web and mobile applications, and any related services, features, or content (collectively, the "Services").
By accessing or using VibeVite, you agree to be legally bound by these Terms. If you do not agree, you may not use the Services.
By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and any additional policies referenced herein.
You must be at least 13 years old (or 16 years old in certain jurisdictions) to use the Services.
By using VibeVite, you represent and warrant that:
You have the legal capacity to enter into these Terms.
You are not prohibited from using the Services under applicable laws.
VibeVite is a SaaS platform that enables users to:
Create events (physical, virtual, or video-only).
Invite guests via email, messaging, or shared links.
Collect video, photo, and audio messages.
Boomatics may update, modify, or enhance the Services from time to time.
You agree to:
Provide accurate, current, and complete information during registration.
Maintain the confidentiality of your login credentials.
Be fully responsible for all activities under your account.
Notify us immediately of any unauthorized access or security breach.
You may not:
Share your account with others without permission.
Use the Services for unlawful, fraudulent, or harmful purposes.
Violate the rights or privacy of other users.
You retain ownership of the content you upload (including videos, photos, and messages). However, by submitting content to VibeVite, you grant Boomatics a limited, non-exclusive, worldwide license to host, store, process, and display such content solely for the purpose of providing the Services.
You are solely responsible for ensuring that:
You have the right to upload the content.
Your content does not violate any laws or third-party rights.
You agree not to:
Upload unlawful, harmful, abusive, defamatory, or infringing content.
Attempt to hack, disrupt, reverse-engineer, or interfere with the platform.
Use automated tools to scrape or misuse the Services.
Violation of this section may result in immediate suspension or termination.
VibeVite is designed to help hosts and guests celebrate, share memories, and preserve special moments. Our plans include generous allowances intended to support the needs of typical personal, family, social, and business events.
To ensure a reliable experience for all users, VibeVite services are subject to reasonable fair-use guidelines.
What is considered fair use?
Fair use includes the normal collection and sharing of:
Photos and videos captured before, during, and after an event
What is not considered fair use?
The platform may not be used for:
General-purpose cloud storage or file backup
Sharing copyrighted, unlawful, harmful, or inappropriate content
Activities that negatively impact platform performance or other users
Uploads and Storage
VibeVite allows guests to contribute an unlimited number of photos and videos, subject to reasonable fair-use limits associated with the selected plan. Most events will never approach these limits.
If an event exceeds normal usage expectations, VibeVite may contact the host to discuss available options, including plan upgrades or additional storage.
Our Commitment
Our goal is to provide a generous and hassle-free experience for every celebration. Fair-use guidelines exist solely to ensure platform reliability, security, and sustainability for all users.
All platform content, software, trademarks, branding, and design elements (excluding user content) are the exclusive property of Boomatics Software LLC or its licensors.
You may not copy, modify, distribute, or create derivative works without prior written permission.
Certain features of the Services may require payment, either on a per-event basis or through a subscription plan.
Payments are processed through third-party payment processors, including Stripe ("Payment Processor"). When you complete a purchase, you may be redirected to or shown a Stripe-hosted checkout experience.
By making a purchase, you agree to:
Pay all applicable fees, taxes, and charges displayed at checkout.
Provide accurate billing information and a valid payment method.
Authorize Boomatics and/or Stripe to charge your selected payment method for the total amount shown at checkout.
Subscription Renewals
If you purchase a subscription, you authorize recurring charges. Subscriptions renew automatically unless canceled before the end of the current billing period. Renewal timing and billing frequency will be shown at checkout and/or in your account.
Where required, applicable taxes may be calculated and added at checkout based on your billing location and other information provided.
Receipts & Billing Descriptor
Your receipt may reference Boomatics Software LLC and/or "VibeVite" as the product/service name. The descriptor shown on your bank statement may vary based on the payment method and processor rules.
a. Event-Based Purchases (Per-Event Plans)
Payments for per-event purchases are non-refundable once an event is created and payment is completed.
Canceling an event does not entitle you to a refund.
Unused invitations, partial use, or lack of guest participation do not qualify for refunds.
This policy exists because platform resources (including storage, processing, and messaging) may be allocated immediately upon event creation.
b. Subscription Plans (If Applicable)
You may cancel your subscription at any time through your account settings.
Cancellation takes effect at the end of the current billing cycle.
You will retain access to subscription features until the billing period ends.
No partial refunds are provided for unused subscription time.
c. Exceptional Circumstances
Refunds may be considered only in limited cases such as:
Extended service outages caused solely by VibeVite
Refund requests must be submitted within 7 days of the charge date by emailing

We may suspend or terminate your account, with or without notice, if:
You may terminate your account at any time by using account settings (if available) or contacting support.
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Boomatics disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
To the maximum extent permitted by law, Boomatics Software LLC shall not be liable for any indirect, incidental, consequential, or punitive damages. Boomatics' total liability for any claim shall not exceed the amount paid by you to VibeVite in the 12 months preceding the claim.
We may update these Terms from time to time. Material changes will be communicated via the Services or email. Continued use of VibeVite after updates constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
